Will.i.am sued by I.am clothingProminent pop music producer, musician and singer for the Black Eyed Peas Will.i.am is currently being sued by a clothing company for breach of contract.

The company, called I.am Clothing, claims that Will.i.am agreed to a sponsorship deal extending through 2016. The terms of the deal include Will.i.am allowing the company to use his name for marketing purposes, assisting with creative design, and providing major advertising and promotional support. For his part, the singer claims that the terms of the 2010 contract have expired and that he is no longer obligated to provide these services. The company is seeking damages of $2 million to cover lost profits that would have resulted from Will.i.am’s involvement.

About breach of contract

Breach of contract lawsuits are always difficult to file due to being based on future claims. It is a subjunctive legal ruling, meaning that its damages are based on what would have happened rather than on something that already happened. While it may be relatively easy for a judge to determine the accuracy of Will.i.am’s claims that he is no longer bound by the contract, it is somewhat more difficult to prove how much money would have been lost.

Both sides of the suit

Will.i.am’s claim that he is no longer legally obligated by the terms of the contract will likely be based on inconsistencies or vague language regarding different provisions in the contract held by I.am Clothing. For its part, the clothing line manufacturer will claim that the document obligates the singer to actively participate in promotional and creative consulting capacities through 2016. If the obligation is deemed broken, then the manufacturer will have to show that the singer’s breach of contract led to losing $2 million in future profits.

Lawsuits of this nature are frequently levied against musicians. Because the details of the contract are not available in the public record, we are unable to determine who has the better case.
