Lindsay Lohan Truck Accident Drama Unfolds

Lindsay Lohan can’t catch a break!

As reported in last week’s Hollyweek in Review, Lohan was involved in an accident with a truck Friday afternoon. Lohan rear-ended a truck while driving a rented Porsche on Pacific Coast Highway in Santa Monica and totaled the vehicle. She briefly went to the hospital but was released that same day and supposedly returned to work on Liz and Dick, the Lifetime movie where she is playing titular character Elizabeth Taylor.

Here’s where things get interesting: Lohan originally claimed that the truck driver cut her off, causing the accident. The driver — called only James on TMZ and other news sites — fired back saying that he did no such thing, and that there are eyewitnesses who can support his side of the story. Lohan then altered her story to say that the brakes on the rental car weren’t working, and that she tried to stop her vehicle but nonetheless collided with the truck.

Right now Lohan appears to be more liable for the accident than any other party, which means James has the right to sue for any injuries he sustained as well as other damages. TMZ reports that James initially said he was fine but has since hired an attorney to represent him in what will most likely turn into a personal injury lawsuit. James told TMZ that he saw a doctor Sunday and was advised not to describe any of his injuries to the public.

Some may question whether James is truly injured when his initial statements indicated he was okay, but a San Jose auto accident attorney can tell you that it often takes a few days for injuries such as whiplash to become noticeable after an accident. This is in part because heightened levels of adrenaline (which is a common side effect of a collision) mask pain, and muscle injuries and soreness take time to surface. Lohan is extremely lucky to have walked away from this accident relatively unscathed — accidents involving large trucks are some of the most deadly on the road — but it sounds like her legal troubles may be beginning all over again.
